75 Hamilton Street Gisborne
An applicant sought expert evidence report to VCAT on the development of this site for 16 dwellings on a 9000m2 in the Residential 1 Zone. The site had never been developed, was vacant and has scattered perimeter vegetation located along some of the title boundaries.
Macedon Ranges Shire had refused the application with the grounds of refusal relying on the proposed strategy and provisions of Amendment C59, in that the site is outside the preferred area for medium density dwellings. It was identified that the structure plan also identifies other areas outside and not contiguous with this preferred area and further away from the township centre. Given the sites location outside of this preferred area, Council considered that an 800m2 lot size should apply.
The single storey nature and low density (1:575m2) of the design response meant compliance with Clause 55 was easily achieved. VCAT (see decision 1578/2008) directed the issue of a planning permit.
